Terms of Service Summary (Plain English)
1. Acceptance of Terms & Eligibility
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Qbonic Technology LLP ("Company", "we", "us", or "our"), an Indian limited liability partnership, governing your access to and use of the Qbonic software platform, website, and related services (collectively, "Qbonic" or the "Service").
By creating an account, clicking "I agree", accessing, or using Qbonic, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service.
Age & Capacity Restriction (COPPA / Minors): You represent and warrant that you are at least 18 years of age (or the legal age of majority in your jurisdiction) and have the full legal capacity to enter into these Terms. Qbonic is a business analytics software and is NOT intended for or directed at children under the age of 16 (or under 13 in the United States).
2. Description of Service & 100% In-Browser Architecture
Qbonic is an in-browser analytics and interactive data-cube reporting tool designed for marketers, analysts, and operators.
Crucial Architecture Guarantee: Qbonic processes dataset transformations, aggregation math, pivot cube computations, and metric evaluations 100% locally inside your web browser's memory (Client-Side DOM / Web Workers). Your underlying CSV data, Google Sheets contents, and private spreadsheets are NEVER uploaded to, processed on, or stored on our cloud servers. You retain 100% ownership and control over your data files at all times.
3. Scope of Cloud Data Storage (Auth & Payment Info Only)
You acknowledge and agree that the only user information persisted on Qbonic's cloud database ({env}_users) consists of:
1. Authentication Data: Work email address, display name, user ID (UID), email verification status, and login timestamps (authenticated via Google Firebase Auth).
2. Subscription & Payment Status: Active plan tier (Free or Pro), billing cycle (monthly or yearly), subscription ID, customer ID, auto-renew status, and period expiration dates.
3. Audit History & Consents: Immutable records of terms acceptance timestamps and subscription transition history.
Zero Business Data Stored: Qbonic servers store no customer CSV records, no spreadsheet cell contents, and no financial banking/card details.
4. Local Storage of Report Configurations & No Liability for Data Loss
Disclaimer on Local Storage: All report configurations, customized KPI formulas, workspace draft states, chart layouts, and pivot setups created in Qbonic are stored exclusively in your local web browser storage (LocalStorage / IndexedDB) on your personal device. None of your report configurations or custom formulas are synced to or stored on Qbonic cloud servers.
NO LIABILITY FOR CLIENT DATA LOSS: Qbonic Technology LLP is NOT liable or responsible for any loss, corruption, erasure, or unrecoverability of your report configurations, customized metrics, or workspace states resulting from:
- Manual or automated browser cache, cookie, or storage clearing.
- Browser uninstallation, browser updates, profile switching, or operating system resets.
- Using Incognito / Private browsing mode (which deletes local storage upon window closing).
- Local device storage exhaustion, disk errors, or hardware failure.
- Third-party browser extensions, ad blockers, or cleanup utilities.
- Switching between different devices, computers, or browsers.
You are solely responsible for maintaining independent records of your custom metrics and formula definitions.
5. User Feedback, Feature Suggestions & IP Assignment
We welcome feedback, comments, ideas, and suggestions for improvements to Qbonic ("Feedback").
Full Assignment & Royalty-Free Rights: If you submit or suggest any Feedback, ideas, workflow concepts, or feature requests to us (via support emails, feedback surveys, calls, or social channels):
1. Such Feedback is completely voluntary, non-confidential, and gratuitous.
2. You hereby assign and grant to Qbonic Technology LLP an exclusive, perpetual, irrevocable, worldwide, royalty-free, fully paid-up license to use, reproduce, modify, adapt, publish, translate, incorporate, and commercialize such Feedback in Qbonic or any other product without any restriction, compensation, or attribution to you.
3. No Copyright or IP Claims: You agree that if we implement any feature, formula, design, or capability suggested or inspired by you, you shall have no copyright, patent, trade secret, or intellectual property claims over such features or code.
6. Product Usage Analytics & Telemetry
To maintain system stability, debug errors, and improve product performance, Qbonic may collect anonymized or pseudonymized Product Usage Telemetry and Diagnostic Information. This includes:
- Application performance metrics (load times, calculation latency, client memory usage).
- Feature engagement statistics (e.g., whether pivot cubes, formulas, or chart types were utilized).
- Unhandled JavaScript error logs and crash stack traces.
- General browser type, viewport size, and operating system.
Telemetry data contains no personally identifiable business records or spreadsheet contents.
7. Subscriptions, 14-Day Free Trial & Merchant of Record
Qbonic offers Free tier access as well as paid subscription plans ("Qbonic Pro").
- Merchant of Record: Our order process is conducted by our online reseller Kelviq. Kelviq is the Merchant of Record for all our orders. Kelviq provides all customer service inquiries and handles returns. Kelviq is responsible for calculating, collecting, and remitting applicable sales tax, GST, and VAT globally.
- 14-Day Free Trial (No Credit Card Required): All newly registered users are offered an automatic 14-day Pro Free Trial upon account creation without requiring any credit card or payment information upfront (or the option to start directly on the Free tier). You may choose to upgrade to a paid subscription at any time during or after the trial via your in-app Plans Page.
- Transition to Free Tier: If you do not choose to upgrade to a paid subscription at the end of your 14-day trial, your account automatically transitions to the Free plan. All custom reports and configurations created and saved during your trial remain intact and accessible for viewing and interactive filtering; subsequent edits and new saves are subject to Free tier limits (session-only edits).
- Self-Serve Cancellation & Auto-Renew: Paid subscriptions can be canceled or auto-renew disabled at any time with 1 click in your Plans Page. Turning off auto-renew preserves your Pro access until the end of the paid billing cycle without further renewal charges.
- Zero-Refund Architecture & Plan Upgrades: We operate a strict Zero Cash Refund policy. Active monthly subscribers can upgrade to annual billing in-place with the net prorated difference charged to the card on file ($0 cash refund). Annual subscriptions cannot be downgraded mid-cycle.
8. EU Statutory Right of Withdrawal Waiver (Directive 2011/83/EU)
If you are a consumer located in the European Union or the United Kingdom, you normally have a statutory right to withdraw from a distance contract within 14 days without giving any reason.
Express Consent & Waiver: By purchasing a paid subscription or utilizing the 14-day free trial for Qbonic Pro, you:
1. Expressly request and consent to the immediate performance of this digital services contract.
2. Acknowledge and agree that pursuant to Article 16(m) of EU Directive 2011/83/EU (and UK Consumer Rights Act 2015), you lose your statutory 14-day right of withdrawal once the digital service access begins. Because our upfront 14-day trial is completely free with no credit card charged, you retain a 14-day risk-free evaluation period.
9. User Indemnification (Defend & Hold Harmless)
You agree to defend, indemnify, and hold harmless Qbonic Technology LLP, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your access to or use of the Service;
- The contents of any CSV files, spreadsheets, or data processed locally by you;
- Your violation of these Terms or any applicable local or international law;
- Your infringement or violation of any intellectual property, privacy, or other rights of any third party.
10. Limitation of Liability & "As Is" Warranty
To the maximum extent permitted by applicable law in India, the United States, Canada, the European Union, Australia, and other jurisdictions:
1. "AS-IS" DISCLAIMER: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory (including implied warranties of merchantability, fitness for a particular purpose, and non-infringement).
2. NO CONSEQUENTIAL DAMAGES: In no event shall Qbonic Technology LLP, its directors, officers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, revenue, commercial goodwill, or business interruption).
3. LIABILITY CAP: In all circumstances, our total cumulative liability arising out of or related to these Terms or the Service shall be strictly capped at the total amount actually paid by you to us in the three (3) months preceding the claim, or USD $50.00, whichever is lower.
11. Class Action Waiver & Binding Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
1. Informal Dispute Resolution: Before initiating any legal proceedings, you and Qbonic Technology LLP agree to attempt in good faith to resolve any dispute, controversy, or claim informally by emailing legal@qbonic.com.
2. CLASS ACTION WAIVER: YOU AND QBONIC TECHNOLOGY LLP AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE DISPUTES IN ANY FORUM WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR QBONIC TECHNOLOGY LLP WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.
12. Australian Consumer Law (ACL) Statutory Notice
For consumers in Australia: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Competition and Consumer Act 2010). Nothing in these Terms excludes, restricts, or modifies any non-excludable consumer guarantee or remedy available to you under the Australian Consumer Law.
13. DMCA & Copyright Infringement Procedures
We respect the intellectual property rights of others. If you believe that any material available on or through Qbonic infringes upon any copyright you own or control, please promptly send a written notification to our Designated Copyright Agent at:

14. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the substantive laws of India, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the competent courts located in India.
Nothing in this clause deprives consumers in the EU/UK, USA, Australia, or Canada of statutory consumer protection rights that cannot be waived by contract.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. When material revisions occur, we will update the "Effective Date" at the top of this document. Continued use of Qbonic following notice constitutes acceptance of the revised Terms.
